The Tallapoosa Judicial Circuit is comprised of Polk and Haralson Counties and serves approximately 66,200 persons. The Tallapoosa Judicial Circuit is part of the Seventh Judicial Administrative District.

Polk County Superior Court

Superior Court business for Polk County is conducted in the Polk County Courthouse, No. 1 at 100 Prior Street, Cedartown, Georgia. The terms of court are the third Monday's in March and July.

Superior Court is a trial court of general jurisdiction. The court has exclusive, constitutional authority over felony cases, prosecuted by the District Attorney's Office, cases regarding title to land, divorce, and equity, declaratory judgments, habusa corpus, mandamus, quo warranto and probation, and adoptions. Except for certain probate or juvenile matters, this court may exercise jurisdiction over other cases concurrently with the limited jurisdiction courts. This court is authorized to correct errors made by lower courts by issuing certiorari and, for some lower courts, the right to direct review by the court applies.

Probate Court exercises jurisdiction in the probate of wills, the administration of estates, the appointment of guardians, and the involuntary hospitalization of incapacitated adults and other dependent individuals. This court also administrers oaths of office and issues marriage licenses, birth certificates, death certificates, gun permits, and hears traffic cases.

Traffic Court is held on the 2nd, 3rd, and 4th Thursday of each month.
Probate Court is held on the 1st Monday of each month.

Juvenile Court exercises jurisdiction over cases involving children who are alleged to be deprived, delinquent, unruly, in need of treatment or commitment as a mentally ill or mentally retarded child, or to have committed a juvenile traffic offense. The Court also exercises jurisdiction in certain cases involving the termination of parental rights, custody, child support and legitimation.
